Violation of an International Treaty

Description: The applicant registered as a candidate by the Election Commission. On October 29, 2005, the Election Commission applied to the Court of Appeals requesting to cancel that applicant’s registration as a candidate. The Election Commission stated that the applicant gave money to a voter promote his candidacy, pay for votes, and interfere with the opponent's campaign. Additional complaints alleged that the applicant insulted opponents and the government during campaign speeches and physically interrupted opponent’s meetings with voters. The Court of Appeals heard this evidence and found it sufficient to find a breach of electoral law. The applicant then appealed to the Supreme Court and that court again affirmed. The applicant again appealed to the current court alleging a violation of Article 3 of Protocol No. 1. The Court found that there was a violation to Article 3 of Protocol No. 1 because the disqualification was not based on sufficient relevant evidence when the applicant was not permitted to provide a defense or given time to prepare arguments for the appeal.
