Thus, the Constitutional Court of Ukraine held to recognize as nonconforming to the Constitution of Ukraine (unconstitutional) the provisions “with proportional assignment to all single-seat districts, established on the territory of the capital of Ukraine – the city of Kyiv» of Article 22.2 of the Law “On the Elections of the People’s Deputies of Ukraine” dated November 17, 2011 No.4061-VI.

Judgment

Summary: The Constitutional Court of Ukraine has declared the provisions of Art.22.2 of the Parliamentary Elections Law of Ukraine concerning the equal allocation of foreign polling stations to all single-member constituencies of Kyiv city unconstitutional. According to the original provision, polling stations abroad created by the Central Election Commission at foreign diplomatic missions of Ukraine, in military units (formations), deployments outside Ukraine, should have been attributed with equal distribution to all single-member constituencies created in the capital of Ukraine - Kyiv.

Conclusion: According to the decision of the Constitutional Court, foreign polling stations were not included in any single-member constituencies and were part of a single multi-member national constituency, and voters were able to vote in these polling stations only for party lists
