Guidelines for Understanding, Adjudicating, and Resolving Disputes in Elections To add specificity and clarity to the objective it should be assumed that each is preceded by the phrase, “by the end of training, participants will be able to:” • Articulate the importance of consistency, neutrality and fairness in resolving election complaints; • Identify and refer to the relevant laws that govern the election complaints processes; • Identify the different bodies responsible for adjudicating election complaints; • List the general categories of complaints that might be filed and identify the relevant adjudication body to which they must be referred; • Identify the individuals or entities who are entitled under the law to file election complaints; • Define the deadlines by which complaints must be filed and the timelines by which they must be decided; • List the types of complaints that could be lodged: - during the registration of parties and candidates; - regarding the registration of voters; - during the campaign period; - on Election Day; - during the counting and tabulation of results; • Fill out all of the forms related to electoral complaints without omissions or mistakes; • Demonstrate an understanding of basic principles involved in investigating election complaint cases; • Understand the burden of proof required for a complaint to be successful; • Demonstrate an understanding as to the administrative remedies that can be applied by EMBs at the polling station level, the District or Regional Level and at the Central level; • Identify the conditions under which recounts are to be conducted, results are to be annulled, or repeat elections are to be called; • Differentiate between an administrative and criminal complaint; 136
