one
of
the

Century; ‘The reason of the law is the life of the
law, for tho’ a man can tell the law, yet if he knows
not the reason thereof, he shall soon forget his
superficial knowledge, but when he findeth the right
reason of the law and so bringeth it to his natural
reason that he comprehended it as his own, this will
not only serve him for the understanding of that
particular
case
but
of
many
others.’

If we look at the foundations of the English
legal
system,
we
find
that
the
Judiciary
as
an
independent third branch of the State still survives
as
an
ideal,
though
not
as
part
of
the
British
constitution. Whatever critics of Dicey’s theory of
the ‘Rule of Law’ may say of our time and generation,
it cannot be doubted that the common law played a
tremendous part in the events which led up to the
