[2012] 3 R.C.S. opitz c. wrzesnewskyj  La Juge en chef 147 [206]  In my view, the application judge erred in setting these 10 votes aside. The record establishes that each of these voters was qualified, registered in a polling division within the electoral district and properly identified before they cast their ballots. The difficulty is that the polling station in Etobicoke Centre where they cast their ballots was not the polling station for the polling division in Etobicoke Centre where they were registered to vote. Section 6 of the Act expressly states that a person on the list of electors is only entitled to vote at the polling station for the polling division in which she is listed. [206]  À mon avis, le juge saisi de la requête a fait erreur en écartant ces 10 votes. Il ressort du dossier que tous ces électeurs avaient qualité d’électeur, étaient inscrits dans une section de vote de la circonscription et s’étaient identifiés correctement avant de voter. Le problème tient à ce que ces électeurs ont voté dans un bureau de scrutin d’Etobicoke-Centre qui n’était pas le bureau de scrutin de la section de vote d’Etobicoke-Centre où ils étaient inscrits. L’article 6 de la Loi énonce expressément qu’une personne ne peut voter qu’au bureau de scrutin établi pour la section de vote où son nom est inscrit sur la liste électorale. [207]  In this case, the fact that 10 votes were cast at the wrong polling station within the riding is a merely technical or trivial deficiency. It is therefore not an irregularity within the meaning of s. 524(1)(b) and these votes should not be set aside. In essence, the 10 electors placed their ballots in the wrong box. Because the ballots from all boxes in an electoral district are aggregated to determine the winning candidate, placing a ballot in the wrong box does not impact the overall tallies for the district. There is no evidence or suggestion of double-voting. Ultimately, the problem here went simply to where the votes were cast within the electoral district. Often, the polling stations for different polling divisions are grouped together in a central polling location. The error might have been as minor as walking to the wrong table in the room where voting was taking place. As a result, I am of the view that the deficiency affecting these 10 votes is inconsequential and, as a result, may be considered technical or trivial. For this reason, these votes should not be set aside. [207]  En l’espèce, le fait que 10 électeurs aient voté au mauvais bureau de scrutin à l’intérieur de la circonscription constitue un manquement de pure forme ou insignifiant. Il ne s’agit donc pas d’une irrégularité au sens de l’al. 524(1)b), et les votes de ces électeurs ne doivent pas être écartés. Les 10 électeurs ont essentiellement déposé leur bulletin de vote dans la mauvaise urne. Puisqu’on regroupe les bulletins de vote de toutes les urnes d’une circonscription pour déterminer quel est le candidat élu, le dépôt d’un bulletin de vote dans la mauvaise urne n’a aucune incidence sur le décompte total des votes enregistrés dans la circonscription. Rien ne prouve ou ne donne à penser qu’un électeur a voté deux fois. Tout compte fait, le problème qui se pose ici ne concerne que l’endroit où les électeurs ont voté à l’intérieur de la circonscription. Il arrive souvent que des bureaux de scrutin établis pour différentes sections de vote soient réunis dans un lieu central. Cette erreur était peut-être aussi anodine que le fait de se présenter à la mauvaise table de la salle où se déroulait le scrutin. Par conséquent, je suis d’avis que le manquement entachant ces 10 votes est sans conséquence et peut être considéré comme de pure forme ou insignifiant. Pour cette raison, il ne faut pas écarter ces votes.  [208]  My conclusion in respect of these 10 votes should not be understood as undermining the practical importance of polling divisions. Polling divisions are key administrative units around which elections are organized, ensuring that voting proceeds in an orderly fashion, and they ought to be respected. [208]  Ma conclusion sur ces 10 votes ne doit pas être perçue comme diminuant l’importance pratique des sections de vote. Ce sont des entités administratives capitales autour desquelles les élections sont organisées de façon à ce que le scrutin se déroule de façon ordonnée et elles doivent être respectées.
