Shura Council Speaker's request for constitutional review of the drafted law.

Judgment

Question Presented: Whether the proposed provisions are constitutional.

Alleged Acts: The President or the House of Representatives may present a draft of laws for the Supreme Constitutional Court to determine their compliance with the Constitution. In particular, the drafted law set forth conditions for voting including the fair representation and voting system for specific boundaries. The drafted law also included a provision that determined that candidate lists may be separate or together.

Summary: The court analyzed the boundaries for particular jurisdictions and determined that those with comparable populations had very different representatives quantities, up to 50% different. Additionally, the court determined that the part list provision must be expanded to indicate that political party or independent status of the candidates if a single ballot is used.

Conclusion: The court determined that the boundaries and existing language surrounding the ballots violated the constitution. The court mandated rephrasing of the ballot procedure and a new scheme.
