Violation of an International Treaty

Description: The applicants in this case allege that their right to free elections, as set forth under Article 3 of Protocol No. 1, was breached by biased media coverage in the 2003 parliamentary elections and forfeiture of election seats to the next person in line from the political party. The court determined that there was not a violation of Article 3 of Protocol No. 1 because the legislature was able to modify election laws, provided those modifications stay within the margin of appreciation and that although the Court was concerned by the mass forfeiture of seats, it could only analyze the law generally as far as its ability to violate Article 3 of Protocol No. 1 and found no violation therein.
