ELECTIONS OF MEMBERS OF PARLIAMENT OF UKRAINE, 2019 Forms of PEC member evasion of work: – Absence during sessions and during voting; – Absence during duty shifts determined by PEC decision; – Refusal to take an oath which affects authorization of the election commission. The commission becomes fully authorized when no less than two-thirds of its minimum membership have taken their oaths. For a small polling station, seven are authorized; eight for a medium-sized polling station and 10 for a large polling place. If the PEC session cannot begin, the Chair and commission members determine why commission members failed to attend and notify the DEC by telephone. The DEC immediately notifies the members of the need to replace the PEC members or, by majority vote, terminates the power of PEC members to ensure authorization of the session. Lack of communication with a PEC member and failure to provide valid reasons for not being on duty or at a meeting on election day may contain elements of a crime under part 1 of Article 157 of the Criminal Code (evasion of an election commission member without a valid reason). The PEC session is authorized if more than half of commission members are present. For example, if the PEC includes 18 people, the presence of a minimum of 10 members of the commission is required to authorize its session. 25
