ELECTIONS OF MEMBERS OF PARLIAMENT OF UKRAINE, 2019 If a voter is forced to disclose content of their vote, such actions may constitute obstruction of the citizen’s free exercise of their voting right, along with coercion (part 1 of Article 157 of the Criminal Code). PECs are responsible for ensuring confidentiality of the expression of citizens’ will during voting (part 2 of Article 85 of the Law). If a voter completes a ballot outside the voting booth, or another person completes that voter’s ballot, even at the voter’s request, without the PEC Chair or other PEC members being aware of this; if the voter is in the voting booth with another voter without the PEC Chair or other PEC members being aware of this; or, if another voter drops the completed ballot into the ballot box without the PEC Chair or other member being aware of this – these actions are violations of the statutory voting procedure which does not constitute a separate crime or administrative offense. The election commission is responsible for preventing such situations and drafting statements of offense when these actions occur. If there is a suspicion that such actions are a preparation or an attempt to impede the free exercise of a citizen’s right to vote, combined with coercion (part 1 of Article 157 of the Criminal Code) or, is an intentional violation of the confidentiality of voting (Article 159 of the Criminal Code), the police officer informs the operative officer on duty and calls the investigative task force. 33
