the Commission to devise administrative mechanisms to ensure
compliance with the gender principle.
153. From the record, it is apparent that the political parties did not
comply with their part of the order. As such, the Commission had to
step in and ensure compliance with the judgment by devising
administrative mechanisms to that end.
154. According to the Commission, the impugned decision is the
administrative mechanism it settled for in ensuring compliance. It
is, therefore, the constitutionality of that administrative mechanism
which the Petitioners are challenging in the consolidated Petitions.
The consolidated Petitions, hence, have nothing to do with
challenging the judgment in the Katiba case. The Petitioners are only
questioning whether the Commission in taking steps to comply with
the judgment in the Katiba case by way of the impugned decisions
acted within the Constitution and the law.
155. The instant issue under consideration, hence, mirrors the impugned
decision against Articles 10 and 47 of the Constitution for want of
public participation, stakeholder consultations and administratively
fair procedures. I will first deal with the aspect of public engagement.
156. The concept of public participation and stakeholders’ consultation
was discussed in great detail in Mombasa High Court Constitutional
Petition No. 159 of 2018 consolidated with Constitutional Petition
No. 201 of 2019 William Odhiambo Ramogi & 3 Others vs. The
Attorney General & Others (2020) eKLR where the Court stated as
follows: 116. Article 10 provides for the national values and principles of
governance which bind all State organs, State officers, public
officers and all persons whenever any of them applies or
interprets the Constitution, enacts, applies or interprets any
law or makes or implements any public policy decisions.
117. The Constitution also provided for alignment of the laws then
in force at its promulgation. Section 7(1) of the Sixth Schedule
states as follows: -
