Description: The election stood in the election as a candidate for the Azadliq opposition bloc. After the election day, the candidate obtained copies of the official records from all forty-one Polling Stations. The applicant alleged that the records had be falsified in favor of the opponents. The Election Commission notified the applicant that it would invalidate the election results for the entire election results of the Zaqatala Election Constituency. The applicant lodged an appeal stating that the Election Commission’s decision should be quashed and he declared the election winner. The Court of Appeals did not independently reexamine the facts, but instead stated that decision was lawful. The application lodged a cassation allege stating that the Commission failed to consider the possibility of a recount. The Supreme Court rejected the appeal and applicant petitioned the current court. The Court determined that there was a violation of Article 3 of Protocol No. 1 because the Election Commission’s decision lacked sufficient evidence to invalidate the election.
