Violation of an International Treaty

Description: The applicant stood was a candidate in the 2005 Parliamentary elections and a member of the opposition bloc Azadliq. Candidate Z.O. received the highest number of votes cast in the constituency and the applicant alleged that local and executive authorities interfered with election process in favor of Z.O., Z.O. constituents intimidated other voters, incorrect voter lists, instances of multiple voting, and ballot-box stuffing. The court determined that there was a violation of Article 3 of Protocol No. 1 because the Election Commission and domestic court failed to show any genuine concern or otherwise investigate the complaint.
