Description: Based on reported election fraud in the parliamentary election the Saakashvili-National Movement and United Democrats moved for the removal of the President and refused to accept the 2003 results. The prior parliament was reinstated until a new parliament could be convened. The elections results remained valid for single member constituencies and all representatives chosen through the parliamentary system annulled and a new election set for March 28, 2004. The applicants allege a violation of Article 3 of Protocol No. 1 and Article 14 during the repeated election and de facto disenfranchisement of 60,000 votes in two districts. Ultimately the court determined that there was violation of Article 3 due to the disenfranchisement of the voters in those two districts due to the election commission's conflict of interests
