Description: The applicant stood for elections to Parliament as a member of the opposition bloc Azadliq. The applicant was registered as a candidate with the Election Commission. Fifteen candidates ran for election within that constituency. The applicant received the highest number of votes in the constituency and was indicated at the elected candidate. On November 8, 2005, the Election Commission invalidated the election result in its entirety for the Sumgayit Second Electoral Constituency. The Election Commission noted impermissible alterations in five of the polling stations and the applicant said that these alterations were made to reduce the number of votes in her favor. The applicant complained that the Election Commission failed to consider the possibility of a recount of the votes. The Court of Appeals did not examine the original CEC or Election Commission protocols, but reiterated the findings and stated that the invalidation was unlawful. The court ultimately determined that there was a violation of Article 3 of Protocol No. 1 because although it did not appear from the record that the alterations succeeded in altering the election results, the invalidation of the election did so. Further, this appeared to be a disregard for the established domestic procedure.
