ELECTIONS OF MEMBERS OF PARLIAMENT OF UKRAINE, 2019 Note Actions related to exercising the right to vote include refusal to participate in voting, voting at a polling station (referenda polling station) more than once, voting or refusing to vote for an individual candidate and handing over a ballot to another person who casts the vote regardless of expression of the person’s will. The legislation distinguishes between direct and indirect bribing of voters and establishes administrative and criminal liability. Direct voter bribery is defined as a proposal, promise or an illegal benefit for the voter in exchange for actions or omissions related to the direct exercise of his or her voting right such as refusal to vote, voting to invalidate the ballot and voting for a candidate or party. If the amount provided in exchange for consent and acceptance of goods, work and services exceeds UAH 57.63 (three percent of the living subsistence level in Ukraine – 3*1921/100=57.63) criminal liability is created both for the voter and for the person who offers such goods, works and services. If the amount is less than or equal to UAH 57.63, the violation is an administrative liability for the person who offers and provides illegal benefits for election campaigning that contradicts the Constitution and the Laws of Ukraine (Article 212-10 of the Code of Administrative Offenses). 43
