ELECTIONS OF MEMBERS OF PARLIAMENT OF UKRAINE, 2019 If actions provided for in parts 1-2 of Article 161 of the Criminal Code were committed by an organized group of people or caused serious consequences, these may include prison for a term of five to eight years. The term “discrimination” is defined by the Law of Ukraine “On Principles of Preventing and Combating Discrimination in Ukraine” as a situation in which a person or group of persons are restricted in recognition, exercise or enjoyment of their rights and freedoms which were, are or may be established or implied on the grounds of race, gender, age, disability, ethnic and social origin, citizenship, marital and property status, place of residence, language and political, religious and other beliefs (paragraph 2 of the first part of Article 1). The Law of Ukraine “On Equality of Men and Women” defines discrimination on grounds of gender in which a person or group of persons is restricted in recognition, exercise or enjoyment of rights and freedoms or privileges, which were, are or may be established or implied, restrictions in recognition, exercise or enjoyment of rights and freedoms or privileges. Discrimination may be established or implied in any form, except where such restrictions or privileges have a legitimate objective, justified purpose. Sexual harassment, in turn, is defined as actions humiliating or insulting persons who are in a relationship of labor, official, material or other subordination, and is expressed verbally (through threats, intimidation, obscene remarks) or physically (through touching, slapping). In the event discrimination allegations concerning the right to vote or sexual harassment by election commission members or others, the police officer is required to respond. 61
